Agreement to Our Legal Terms

We are Selah ('we,' 'us,' or 'our'). We operate the Selah mobile application (the 'App'), as well as any other related products and services that refer or link to these legal terms (collectively, the 'Services').

Selah is a faith and devotional application that provides access to scripture, tools for personal reflection, and features powered by artificial intelligence that generate reflections and responses to spiritual questions and prayers.

These Terms & Conditions ('Terms') constitute a legally binding agreement made between you, whether personally or on behalf of an entity ('you'), and Selah, concerning your access to and use of the Services. By accessing or using the Services, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Services and you must discontinue use immediately.

We may update these Terms from time to time. The updated version will be indicated by an updated 'Last updated' date. By continuing to use the Services after revised Terms take effect, you agree to be bound by them.

1. Eligibility and Minimum Age

You must be at least 13 years of age to use the Services. By using the Services, you represent and warrant that you are at least 13 years old. If you are under the age of 18 (or the age of majority in your jurisdiction), you represent that you have reviewed these Terms with a parent or guardian and that they have given permission for you to use the Services. We do not knowingly permit anyone under 13 to use the Services, and we will deactivate and delete any account we discover belongs to a child under 13.

2. Your Account

To use certain features of the Services, you may register an account using your Google or Apple account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account.

3. AI Features and Important Disclaimer

The Services include features powered by artificial intelligence that generate reflections, explanations, and responses to questions and prayers ('AI Features'). Please read this section carefully.

AI-generated content is not authoritative and may be inaccurate. Responses produced by the AI Features are generated automatically and may be incomplete, incorrect, or theologically contested. They do not represent the official position of any church, denomination, religious authority, or of Selah itself, and should not be treated as religious, spiritual, or doctrinal authority.

AI-generated content is not professional advice. The Services are not a substitute for professional advice. The AI Features do not provide, and must not be relied upon as, medical, mental-health, legal, financial, or professional pastoral or counselling advice. If you are experiencing a crisis, distress, or a medical or mental-health emergency, contact a qualified professional or your local emergency services. Do not rely on the Services for decisions affecting your health, safety, finances, or legal rights.

You are solely responsible for how you interpret and act upon any output of the AI Features. You agree not to submit content to the AI Features that violates these Terms or the policies of our AI service providers.

4. Your Content

The Services may allow you to create, store, and share content such as notes, highlights, reflections, saved insights, prayers, and other text you submit ('Your Content'). You retain ownership of Your Content. By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, and display Your Content solely as necessary to operate and provide the Services to you, including by transmitting relevant content to our third-party AI and infrastructure providers as described in our Privacy Policy.

You are responsible for Your Content and represent that you have the necessary rights to submit it and that it does not violate these Terms or any applicable law.

5. Prohibited Activities

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
• Use the Services to harass, abuse, harm, or distribute hateful, threatening, or unlawful content;
• Attempt to gain unauthorised access to the Services, other users' accounts, or our systems;
• Reverse engineer, decompile, scrape, or attempt to extract the source code of the Services, except where permitted by law;
• Use the Services to develop a competing product or to train other machine-learning or AI systems;
• Interfere with, disrupt, or place an unreasonable load on the Services or their infrastructure;
• Use any automated system or bot to access the Services in a manner that sends more requests than a human could reasonably produce.

6. Intellectual Property

Unless otherwise indicated, the Services and their content — including the design, text, graphics, logos, and software (excluding Your Content and third-party content) — are owned by or licensed to us and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial use. You may not copy, reproduce, distribute, or create derivative works from the Services except as expressly permitted.

Scripture and other third-party materials made available through the Services may be subject to their own copyright and licence terms held by their respective rights holders.

7. Third-Party Services

The Services rely on and integrate with third-party providers, including Google and Apple (for sign-in), and OpenRouter and Google (for AI Features), as well as infrastructure, analytics, and error-monitoring providers as described in our Privacy Policy. Your use of the Services may also be subject to the terms of the app store from which you downloaded the App (the Apple App Store or Google Play). We are not responsible for the practices, content, or availability of third-party services, and your dealings with them are governed by their own terms and policies.

8. Availability and Changes to the Services

The Services are currently provided free of charge. We may modify, suspend, or discontinue the Services (or any part of them) at any time, with or without notice. We do not guarantee that the Services will always be available, uninterrupted, or error-free. We reserve the right to introduce paid features in the future, in which case additional terms may apply.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES OR ANY AI-GENERATED CONTENT WILL BE ACCURATE, RELIABLE, COMPLETE, OR ERROR-FREE. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD 50. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, Your Content, your violation of these Terms, or your violation of the rights of any third party.

12. Term and Termination

These Terms remain in effect while you use the Services. You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or for any other reason. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, and you agree to submit to the non-exclusive jurisdiction of the courts located in the Emirate of Dubai, without regard to conflict-of-law principles. Nothing in these Terms affects any mandatory consumer-protection rights you may have under the laws of your country of residence.
